Article 1. - Purpose
The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of Miss Parfait and the Customer in the context of the online sale of the products offered on this site.
Article 2. - General provisions
These General Terms and Conditions of Sale apply to all sales of products made via the seller's website and are an integral part of the contract between the customer and the seller. They can be viewed on the seller's website at: www.missparfait.com. The seller ensures that their acceptance is clear and without reservation by setting up a checkbox and a validation click for each transaction. Thus, the customer declares that they have read all of these General Terms and Conditions of Sale and, where applicable, the Special Terms and Conditions of Sale related to a product or service in order to accept them without restriction and without reservation. The customer acknowledges having had access to the advice and information necessary to ensure that the offer is suitable for their needs. The customer declares that he is able to legally place orders under French law or to validly represent the natural or legal person for whom he is committing. Unless proven otherwise, the information recorded by the seller constitutes proof of all transactional elements. These General Terms and Conditions of Sale are applicable to Orders made for delivery in France or abroad.
Article 3. - Entry into force and Duration
These General Terms and Conditions of Sale are applicable to the parties on the date of validation of the order. These General Terms and Conditions of Sale are applicable for the duration necessary for the supply of the products, until the extinction of the guarantees and obligations owed by Miss Parfaite.
Article 4. - Ordering Products and Services and Stages of Conclusion of the Online Sale
In order to place an order, the Customer must follow the following steps: 1. Enter the address of the Site or access the Site via a link. 2. Follow the instructions on the Site and in particular, the instructions necessary for opening a customer account. 4. Complete the order form. 5. Check the order elements and, if necessary, identify and correct errors. 6. Read the General Terms and Conditions of Sale of Miss Parfaite, accept them, then validate the order and the total amount to be paid. 7. Follow the instructions of the online payment server to pay the total amount indicated. Unless the server is unavailable, the Customer may pay for their order after final validation of the order on the Site. The Customer will receive confirmation by email of the payment of the order, accompanied by an acknowledgment of receipt confirming it. The products ordered will be delivered to the address indicated by the customer. For the purposes of proper execution of the order, and in accordance with Article 1316-1 of the Civil Code, the customer undertakes to provide all elements of identity authenticity. All orders placed on the Site are intended solely for the personal use of the Customer. As a result, the Customer or the recipient of the products are prohibited from any partial or total resale of the products ordered. When carrying out the various stages of the order mentioned above, the Customer agrees to comply with these General Terms and Conditions of Sale. In accordance with Article L. 122-1 of the Consumer Code, Miss Parfaite reserves the right to refuse the order if it appears abnormal (in particular given the quantities ordered), made in bad faith or for any other reason of inadmissibility, in particular, when there is a dispute with the Customer concerning the payment of a previous order.
Article 5. - Product Prices and Conditions of Validity
The price of the products sold on the Site is indicated respectively by item and by reference, except for typographical errors. These prices take into account the VAT applicable on the day of the order but do not include delivery costs which will be invoiced in addition as specified to the Customer when confirming their order. For any order shipped outside the European Union and/or DOM TOM, the price is automatically calculated excluding tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be required in certain cases. These duties and sums are not the responsibility of the seller. They will be the responsibility of the customer and are their responsibility. The seller therefore invites the customer to inquire about these aspects with the corresponding local authorities. At the time of confirming the order, the price to be paid corresponds to the total amount of the order. The product offers and their prices are valid as long as they are accessible on the Site within the limit of available stocks. In this respect, information on the availability of products may be provided to the Customer at the time of placing the order. Errors or modifications may exceptionally exist, in particular in the case of simultaneous orders of the same item by several customers. In the event of unavailability of an item after validation of the order by the Customer, MISS PARFAITE will inform the Customer by email as soon as possible, offering either to order another item presented on the Site as a replacement, or to cancel the order. If the Customer chooses to cancel the order, the refund will be made at the latest within 30 days of payment if the customer's bank account has been debited. MISS PARFAITE reserves the right to change the product lists and/or prices offered on the Site at any time and without notice, it being specified that those in effect at the time of the order will be those accepted by the Customer by validating the latter. The Customer is duly informed that the illustrations, colors, photographs and description of the products are only indicative and do not enter into the contractual field. Alix D Reynis cannot be held liable in the event of an error or inaccuracy. The telecommunications costs inherent in accessing the site remain the exclusive responsibility of the Customer. The validity period of the product offers and prices is determined when the Site is updated.
Article 6. - Payment Terms
Payment is due immediately at the time of ordering. The customer will make payment by credit card. Payment of the amount of the order will be made exclusively through one of the following payment methods: VISA or MASTERCARD. Payments by check and bank transfer are not accepted. The transaction is debited from the Customer's credit card at the time of dispatch and, after verification of the data on the card, upon receipt of the debit authorization from the company issuing the credit card used by the Customer. Once the payment has been initiated by the customer, the transaction is immediately debited after verification of this information. In accordance with Article L.132-2 of the Monetary and Financial Code, the commitment to pay by card is irrevocable upon activation. By communicating the information relating to his bank card, the Customer authorizes MISS PARFAITE to debit his bank card for the amount corresponding to the total amount of the order. The Customer therefore authorizes his bank in advance to debit his account upon viewing the records or statements transmitted via the payment module, even in the absence of invoices signed by the bank card holder. To this end, the Customer confirms that he is the holder of the bank card to be debited and that the name on the card is indeed his. The Customer communicates the sixteen digits and the expiration date of his bank card as well as, if necessary, the numbers of the visual cryptogram. In the event that the debit of the total amount to be paid is impossible, the Customer will be invited to start the payment process again. If the impossibility of debit is confirmed, the online sale will be immediately resolved by operation of law and the order will be cancelled. The occurrence of an unpaid amount due to fraudulent use of a bank card will result in the registration of the contact details associated with this unpaid amount in a payment incident file implemented by a third-party organisation. An irregular declaration or an anomaly may also be subject to litigation.
Article 7. - Delivery of the Order
The products are delivered to the delivery address that was indicated when ordering. The customer is solely responsible for a failure to deliver due to a lack or error in geographical indication. The amount of the delivery costs depends on the amount and nature of the order. In any event, the amount of these costs is indicated to the Customer before the order is validated. Subject to availability of the chosen products, the delivery method is specified to the Customer throughout the order validation and payment process. The delivery time will depend on the final delivery method. Delivery times run from the date of confirmation of the order by Miss Parfaite based on the average preparation and delivery times of the order. Delivery times are provided for information purposes only, and are deemed to have been respected by Miss Parfaite as soon as the first presentation of the order to the address indicated by the Customer has occurred within the time indicated to the latter. In the event of a delay in delivery, the customer has the option of terminating the contract in accordance with the terms defined in Article L138-2 of the Consumer Code. The seller will then refund the product under the conditions of Article L138-3 of the Consumer Code. The seller provides a contact point which is indicated in the order confirmation email which allows its follow-up. The seller reminds that when the customer takes physical possession of his order, the risk of loss or damage to the products is transferred to him. It is therefore up to the customer to notify the carrier of any reservations about the product delivered. The Customer is required to check the condition of the packaging and the items upon delivery. It is up to the Customer to issue any reservations and complaints he deems necessary, or even to refuse the package, in particular when the package is clearly damaged upon delivery, and this, before opening it (for example, if you hear a breaking noise inside). Said reservations and detailed complaints must be indicated to the delivery person and also addressed to the carrier by registered letter with acknowledgement of receipt within three working days, not including public holidays, following the date of delivery of the products. In all cases, it is important to clearly specify the reasons, knowing that a reservation of the type "subject to opening the package" has no value but that a reservation of the type "package badly damaged, chipped at the top left, taped" is an accepted reservation. The Customer must also send a copy of this letter to Alix D Reynis. Failure to make a complaint within the aforementioned period extinguishes any action against the carrier in accordance with Article L. 133-3 of the French Commercial Code. If the package is in good condition, but when opened, the product is damaged, it is up to the Customer to return it to us according to the conditions below for expertise, indicating the reason for the complaint on the return slip. The Customer must ensure that the products delivered to him correspond to the order. In the event of non-conformity of the products in nature or quality with the specifications mentioned in the packing slip, the Customer must return the products, complete and in their original packaging, accompanied by the return form, to the following address: Miss Parfaite 22 PASSAGE VERDEAU 75009 PARIS within seven (7) calendar days following the date of receipt of the order by the Customer. It will be up to the Customer to provide proof of this return, which implies that the items must be returned by CHRONOPOST, or by any other means providing a certain date, the costs and risks of return remaining the responsibility of the Customer. Article 8. - Right of withdrawal
In accordance with Article L.121-20 of the Consumer Code, "the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to provide reasons or pay penalties, with the exception, where applicable, of return costs". "The period mentioned in the previous paragraph runs from the receipt for the goods or the acceptance of the offer for the provision of services". The right of withdrawal can be exercised by contacting the seller by email at bonjour@missparfaite.com. In the event of exercising the right of withdrawal within the aforementioned period, only the price of the product(s) purchased will be subject to the right to reimbursement, the return costs will remain the responsibility of the customer. The returns of the products must be made in their original condition and complete (packaging, labels, etc.) so that they can be resold as new. They must, if possible, be accompanied by a copy of the proof of purchase, and should be sent to:

Article 9. – Complaints

Article 10. – Guarantees
In accordance with the law, the seller assumes a guarantee of conformity as well as a guarantee relating to hidden defects in its products. The seller reimburses the customer for products that are apparently defective or do not correspond to the order placed. The refund request must be made by email to: bonjour@missparfaite.com. Items returned incomplete, damaged, damaged, deteriorated or soiled by the Customer will not be exchangeable and will be returned to him immediately or returned by post as soon as possible.
Article 11. - Intellectual property rights
The brands, domain names, products, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights is made through these General Terms and Conditions. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
Article 12. - Protection of personal data
In accordance with the Data Protection Act of 6 January 1978, you have the right to query, access, modify, oppose and withdraw your personal data. By adhering to these General Terms and Conditions of Sale, you consent to our collection and use of this data for the performance of this contract. By entering your email address on our site, you will receive emails containing information and promotional offers concerning products published by the seller. You can unsubscribe at any time. To do this, simply click on the link at the end of our emails or contact us by registered letter with acknowledgment of receipt. We monitor the traffic on our site, and for this we use tools such as Google Analytics.
Article 13. - Force Majeure
The execution by Miss Parfaite of its obligations under these General Terms and Conditions of Sale will be suspended in the event of the occurrence of a fortuitous event or force majeure that would hinder or delay its execution.
Article 14. - Nullity and modification of the contract
If one of the stipulations of this contract is canceled, this nullity would not entail the nullity of the other stipulations which will remain in force between the parties. Any contractual modification is only valid after a written agreement signed by the parties.
Article 15. Limitation of liability
Miss Parfaite cannot be held liable for damage resulting from the use of the Internet network, such as loss of data, intrusion, computer viruses, connection failure, interruption of the Internet network, or other problems beyond its control. Miss Parfaite reserves the right to suspend operation of the Site at any time.
Article 16. - Non-waiver
The fact that Miss Parfaite does not assert any of the obligations referred to in these General Terms and Conditions of Sale cannot be interpreted for the future as a waiver of the obligation in question.
Article 17. – Applicable law
These General Terms and Conditions of Sale are governed by French law. Any dispute arising from the formation, interpretation or execution of these General Terms and Conditions of Sale shall be subject to the exclusive jurisdiction of the French courts, notwithstanding multiple defendants or third-party claims.
